Use of this software (hereafter referred to as "SOFTWARE") by you or your organization (hereafter referred to as "LICENSEE") constitutes acceptance of the terms of this license. Alcatel and/or its suppliers (hereafter referred to as "LICENSER") grants you the right to install and operate this software without fee provided the full conditions of this license are adhered to.

This SOFTWARE may not be re-distributed without prior written permission from LICENSER.

LICENSEE acknowledges that LICENSER provides this software "as is" and has no obligation whatsoever to provide support under this agreement.

LICENSEE acknowledges that grant of rights under this license does not entitle or indicate any discount with respect to purchasing any other form of license from LICENSER.

This SOFTWARE is protected by United States and European copyright laws and international treaties and provisions. LICENSER retains all intellectual property rights to SOFTWARE under all circumstances. Negotiated payment for the SOFTWARE by LICENSER and LICENSEE does not transfer any intellectual property rights for the SOFTWARE from LICENSER to LICENSEE.

LICENSEE may not attempt to reverse compile, modify, translate, or disassemble the SOFTWARE in whole or in part.

In no event shall the LICENSER of this SOFTWARE or its suppliers be liable to any person or company for any consequential, special, incidental or indirect damages of any kind arising out of the delivery, performance or use of the SOFTWARE, even if the LICENSER has been advised of the possibility of such damages. In no event will the LICENSER'S liability for any claim, whether in contract, tort or any other theory of liability, exceed any license fee that may have been paid by the LICENSEE.

The LICENSER of this SOFTWARE disclaims all warranties with respect to the SOFTWARE, either express or implied, including but not limited to implied warranties of merchantability and/or fitness for a particular purpose. Some jurisdictions do not allow the exclusion of implied warranties or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.

Any errors in this agreement do not void the contents in part or in whole. The LICENSER retains the right to correct any clause or clauses that are in error. 

This agreement between LICENSER and LICENSEE supersedes any prior agreement or understanding, whether written or oral, relating to the subject matter of this license.
